Canadians working in the U.S. and Obtaining a TN Visa
By Glenn Letham
How do I extend a TN after my year is up?
There are 2 choices here.
1. apply at the border again exactly the same way that the original
TN was obtained. Take supporting documents and have them reflect the need for continuation.
2. apply by mail to the INS Northern Service Center in Nebraska. This will take up to 90 days and should be
initiated at least 6 weeks prior to the expiration of the current visa. Petitioners will need to
submit a form I-129 and if there are TD dependants, an I-539. The cost is US $110 for I-129
and US $120 for I-539.
A renewal package should include the following:
- Official cover letter stating contents
- Copy of offer letter with reasons for extension and emphasis on temporary nature of job
- form I-129
- Form I-539 (if necessary)
- copies of passports and original I-94s
- supporting financial documents from company
- articles of incorporation
- Payment
Important - make a copy of package and send it registered mail with "return receipt requested"
The soundest advice I can offer for peace of mind for employees and employers is to purchase
Joe Grasmick's TN handbook available at www.grasmick.com. I bought his "Handbook For business Professionals"
and it was the best Cdn $200 I've spent!
