Canadians working in the U.S. and Obtaining a TN Visa
By Glenn Letham
Some TN Facts:
TN Visas are petitioned by the potential employer not the employee
You must have an official job offer from a legitimate employer in order to be considered for a TN Visa
TN Visas are valid for one year, they are, however, renewable.
The number of renewals is unlimited (but expect hassles after a few years, so I'm told)
TN Visas can be obtained in person at a border crossing in under one hour (in some cases)
Canadian working in the US on a TN will require a (SSN social security number)
If you work in 2 countries during a calendar year you will need to file taxes in both countries.
TN Visa holders working in the US can bring their dependants (wife, husband, kids) - they will require a TD visa (straight forward)
Technically there is no such thing as a TN Visa renewal or extension. Each year a new Visa is required (although its common to refer to this as a renewal)
TN Visas can be obtained at the border or by mail.
A Canadian applying for a TN by mail can expect it take anywhere from 60-90 days (this will vary)
Jumping from a TN to a GreenCard is very difficult
TN Visa holder Dependents cannot work unless they have their own TN or other work visa
TN extensions/renewal by mail must be filed with the INS Northern Service Center in Nebraska
You can apply again if you are refused. Be sure you can explain why you are re-applying (ie. you forgot something or messed something up)
